ARTICLE 1 – Scope
1.1 – These terms and conditions of sale exclusively govern the contractual relationship between sande Paris (hereinafter referred to as sande Paris) and any person (hereinafter referred to as “the customer”) who places an order on the online store (hereinafter referred to as “the site”) at the following address: www.sandeparis.com

1.3 – These terms and conditions apply to all items offered for sale on the site, and are reserved for customers over 18 years of age who have full legal capacity.
1.4 – Any order for one or more items presented on the site implies that the customer has read and unreservedly accepted these terms and conditions of sale and the prices applied. These terms prevail over any other document and over the terms and conditions of sale of the customer’s country.
1.5 – Any failure by sande paris to fulfil one of its obligations set out in these terms and conditions of sale may in no case be interpreted by the customer as a waiver of the terms and conditions of sale. These terms may be updated or amended without notice. The applicable terms will then be those in force at the time the contract is concluded, that is, on the day the order is recorded.
ARTICLE 2 – Information about the items
2.1 – The items and promotional offers on the site are offered for sale subject to available stock and, for offers, until the end of their validity. The presence of an item on the site does not guarantee that it is in stock.
2.2 As these are handmade pieces of jewelry, some stated lengths may vary by plus or minus 10%. Likewise, some materials used may show irregularities inherent in their natural character or in this artisanal method of making.
2.3 – The photographs and texts illustrating the items are provided for information only and do not form part of the contract. Consequently, although shown on the site with the greatest care, the photos and texts may nevertheless contain errors. In that case, sande Paris cannot be held liable.
ARTICLE 3 – Ordering items
3.1 – Orders are placed on the site at the following address: www.sandeparis.com. Items offered for sale are subject to availability. If a product is unavailable, the customer will be informed after placing the order, by email or by post. The order will be confirmed only once the customer has paid the full amount. Sande Paris reserves the right to refuse certain orders deemed invalid.
3.2 – Order confirmation
If the customer wishes to buy one or more items, they must select a model or its reference, set the quantity and then click “cart”. The cart summarises the customer’s selection and allows them to change the order. To confirm the chosen products, the customer must click “order”.
Once this step is complete, the customer will identify themselves, either with their customer code or by entering their personal details in the space provided. They must then choose a payment method, pay the order amount and confirm the information shown on the final order form. An order number will be assigned to the customer. Sande Paris will keep a record of the order as proof of the contractual relationship between the parties.
ARTICLE 4 – Prices of the items
4.1 – The prices displayed on the Site are in euros, inclusive of all taxes (French VAT and other taxes applicable on the day of the order), excluding any contribution to packaging, order processing and shipping costs. Packaging, order processing and shipping costs are shown before the order is confirmed.
4.2 – For all products shipped outside the European Union and to the French overseas departments and territories (DOM-TOM), customs duties or other local taxes, import duties or state taxes may be payable. These amounts are borne by the customer and are their sole responsibility, both for declarations and for payment to the competent authorities.
4.3 – sande Paris reserves the right to change its prices at any time, but products will be invoiced on the basis of the prices in force at the time your order is confirmed.
4.4 – The products remain the property of sande Paris until the order has been paid in full.
ARTICLE 5 – Confirmation
You declare that you have read and accepted these Terms and conditions of sale before placing your order. Confirming your order therefore constitutes acceptance of these Terms and conditions of sale.
ARTICLE 6 – Availability
Sande Paris does not intend to sell the products offered in large quantities. Accordingly, sande Paris reserves the right to refuse orders for the same product in large quantities. Our products are available for as long as they are visible on the site, and outside promotional operations described as such on the site. If a product is unavailable after you have placed your order, we will inform you by email and offer you the choice between a refund of your order or the replacement of the unavailable product or products with other products from our catalogue.
ARTICLE 7 – Payment and security
When paying for the order, the customer may choose from the following payment methods: Payment by bank card (unless the server is unavailable)

- Or by American Express
The customer may pay for purchases directly on the site. The order amount will be debited only when the order is confirmed. Payment by bank card is secured by an SSL encryption system, and we have also strengthened all scrambling and encryption processes in order to protect, as effectively as possible, all sensitive data linked to the means of payment.
Consequently, sande Paris cannot access the customer’s card number, which is transmitted in complete confidentiality. Only national bank cards will be accepted by the security system, as well as Visa, Eurocard and Mastercard, and American Express cards.
ARTICLE 8 – Delivery
8.1 – Transport arrangements
Orders can be delivered anywhere in the world. Sande Paris reserves the right to choose the appropriate means of transport. Orders will be delivered in France by Colissimo.
8.2 – Delivery of the products will take place only after the full order amount has been collected. The products will be delivered to the address given by the customer when the order is placed. Accordingly, the details provided by the customer are deemed to be accurate and, in the event of a dispute, will not engage the liability of sande Paris. If the customer is absent at the time of delivery, the carrier will leave a delivery notice at the address given.
8.3 – In accordance with article L 121-20-3 of the French Consumer Code, the Products ordered are delivered within the times stated on the Site and in the order confirmation, and within 30 working days of the order. The average delivery time is 2 to 5 days. It is given for information only and does not constitute a firm commitment on our part.
8.4 – Delivery outside mainland France
Delivery rates outside mainland France will be calculated once the customer has specified the country in which they wish to be delivered.
8.5 – You can track your order by logging on to www.laposte.fr/colissimo with the parcel number that will be sent to you after dispatch.
8.6 In the event of damage, the customer must state their reservations precisely by registered letter, repeat them to the carrier chosen for the delivery, and notify sande Paris within 3 days of receiving the parcel. No claim will be accepted if these formalities are not followed.
If you receive the product after your cancellation, we will refund the product upon receipt of it, complete and in its original condition.
8.7 – Receipt of the products
The customer is advised to check the condition of the products received before signing the delivery note. Once the note has been signed, sande Paris will consider that the customer has carried out this check.
ARTICLE 9 – Right of withdrawal
9.1 – Under articles L.121-20 et seq. of the French Consumer Code, the customer has 7 clear days to exercise their right of withdrawal without having to give any reason, from the date of receipt of the order. Shipping and return costs are borne by the customer.

The piece of jewelry must be returned by post in new condition and in its original packaging, together with its invoice (including accessories and instructions for use), to the following address:

Refunds will be made by crediting the customer’s bank card within 15 days of receipt of the parcel by the Seller. If a returned product is damaged, incomplete or worn, it will be neither exchanged nor refunded.
ARTICLE 10 – Conformity and product warranty
10.1 – If the products are not in conformity, we ask the customer to inform us by email at contact@sandeparis.com, and to return the product concerned, in new condition and in its original packaging, within 7 working days, to the following address:

10.2 – Warranties
The customer benefits from the statutory provisions relating to the warranty against hidden defects under article 1641 et seq. of the French Civil Code.
10.3 Repairs
We offer a free repair service for one month from the date of purchase, on presentation of proof of purchase. This service is offered free of charge provided that the deterioration of the jewelry is linked to the natural wear of the product and/or a manufacturing defect.
After this warranty period, our after-sales service may offer a paid repair if one is possible. It will be the subject of a quote, which will be submitted to you for acceptance before any repair.
ARTICLE 11 – Retention of title and termination clause
11.1 – The products ordered remain the property of sande Paris until the customer has fulfilled their obligations, in particular payment of the price in full. Once ownership has been transferred, the risks of loss, theft or deterioration of the products are borne by the customer.
11.2 – If the buyer fails to fulfil any of their obligations, the sale will be terminated automatically and without formal notice. The items must be returned to sande Paris within 48 hours.
ARTICLE 12 – Personal information
12.1 -The customer expressly agrees to provide sande Paris with their personal data so that we can manage orders, deliveries and customer relations as effectively as possible.
In accordance with the French law of 6 January 1978 on information technology and civil liberties, the customer has a right of access to and rectification of their personal data. Sande Paris undertakes not to disclose your personal data to third parties.
12.2 – Cookies
sande Paris may use cookies (files containing information stored on the customer’s hard drive). Cookies make the operations the customer carries out on the site easier. They do not contain confidential information about the customer. The customer is nevertheless free to refuse the creation of cookies.
12.3 Hyperlinks
The web pages of the site sandeparis.com also offer links to other sites for which we are responsible neither for their full compliance with public policy and standards of decency, on the one hand, nor for their personal-data protection policy or the use that may be made of such data, on the other.
By accessing another site through a hyperlink, you accept that this access is at your own risk. Consequently, any direct or indirect loss resulting from your access to another site linked by a hyperlink cannot engage the liability of the publisher of the Site.
ARTICLE 13 – Intellectual property rights
The sande Paris website and its content are protected by the legislation in force on copyright and intellectual property. In accordance with the provisions of the French Intellectual Property Code, sande Paris grants the customer a licence to use the site solely for personal use. Any partial or total reproduction of the site or of any of its elements is prohibited (photographs, texts, logos, signs, trademarks, drawings…). The creation or use of hyperlinks to one or more pages of the site or to any of its elements is also prohibited.
ARTICLE 14 – Force majeure
In the event of partial or total non-performance of its obligations caused by a case of force majeure or a fortuitous event, sande Paris will not be liable.
Under article 1148 of the French Civil Code, force majeure arises in a context of unforeseeability and irresistibility. The following are expressly considered cases of force majeure: strikes, in particular strikes affecting means of transport, communications or postal services; regulatory restrictions; attacks; floods, fires, lightning and natural disasters…
ARTICLE 15 – Applicable law and jurisdiction clause
These terms and conditions of sale are written in French and are governed by French law. In the event of a dispute between the parties, the territorially competent court will be the Commercial Court of PARIS – France.
ARTICLE 16 – Personal information
The information and data concerning you are necessary for the management of your order and our commercial relations. They may be passed on to the companies that contribute to these relations, such as those responsible for carrying out the services and orders, for their management, performance, processing and payment. This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations, and to allow us to improve and personalise the services we offer you and the information we send you. In accordance with the French Data Protection Act of 6 January 1978, you have a right of access, rectification and objection in respect of your personal data.
